1. Acceptance of Terms

By downloading, installing, or using GymOrDie ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

1.1 Agreement Acknowledgment

These Terms constitute a legal agreement between you (the end-user) and Peter Minwegen ("we", "us", or "our"), not Apple Inc. or any of its subsidiaries (collectively "Apple"). Apple is not a party to these Terms and has no responsibility for the App or its content.

1.2 Compliance with Apple Media Services Terms

These Terms do not conflict with the Apple Media Services Terms and Conditions. Your use of the App must comply with the App Store Terms of Service.

2. License Grant and Scope

2.1 License Grant

Subject to your compliance with these Terms, Peter Minwegen grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal fitness motivation purposes solely on Apple-branded products that you own or control.

2.2 App Functionality

GymOrDie is a fitness motivation application that allows users to:

  • Care for a virtual pet blob whose health depends on gym visits
  • Track gym visits using location detection
  • Build workout streaks and maintain blob health
  • Set up custom gym locations

3. Free App

GymOrDie is completely free to download and use. There are no subscriptions, no in-app purchases, and no hidden fees. All features are available at no cost.

4. Location Services

4.1 Location Usage

The App uses location services to detect gym visits. Location access:

  • Is required for the app's core functionality
  • Is used only to verify gym attendance
  • Is processed locally on your device
  • Is never transmitted to external servers

4.2 Accuracy

Location detection depends on your device's GPS accuracy and may not always be precise. We are not responsible for missed gym visit detections due to GPS limitations.

5. Virtual Pet

The virtual pet blob in GymOrDie is a fictional digital character. You acknowledge that:

  • The blob is not a real creature
  • The blob's "death" is a game mechanic, not an actual loss
  • You can restart with a new blob at any time
  • The app is designed for entertainment and motivation purposes

6. User Data

GymOrDie stores preferences and visit history locally on your device. We do not collect personal information or location data. See our Privacy Policy for complete details.

7. Maintenance and Support

Peter Minwegen is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance and support services with respect to the App.

8. Warranty

Peter Minwegen represents and warrants that the App conforms to any applicable specifications. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

9. Intellectual Property

The App and all related materials, including software, design, graphics, blob characters, and trademarks, are owned by Peter Minwegen and protected by intellectual property laws. You are granted a limited license to use the App for personal purposes only.

10. Limitation of Liability

FITNESS DISCLAIMER: GymOrDie is designed for entertainment and motivation purposes only. The App:

  • Does not provide medical or fitness advice
  • Is not a substitute for professional fitness guidance
  • Is not responsible for any injuries during workouts
  • Makes no guarantees about fitness results

11. Third Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that Apple will have the right to enforce these Terms against you.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
